Windervale exists for people making things that deserve to be seen, read, heard, watched, discussed and remembered. These terms are here to make sure the place remains useful, safe and fair.
About Windervale
Windervale Labs is a creative platform and community built around independent and underrepresented creative work.
The platform may include creative profiles, human mapping, introductions, projects, editorial material, workshops, events, exhibitions, grants or other forms of creative programming.
By accessing or using Windervale, you agree to these Terms & Conditions. If you do not agree with them, please do not use the platform.
Accounts & profiles
Some parts of Windervale require you to create an account or submit a profile.
You are responsible for providing information that is truthful, reasonably accurate and yours to provide. Please do not create an account pretending to be another person.
Creating a profile does not automatically mean that the profile will be approved, published or included in every part of Windervale.
Windervale may review profiles before approving them. We may also decline, pause or remove a profile where we believe it does not meet the purpose or standards of the platform.
Human Mapping
Human Mapping is Windervale's system for helping independent creatives discover potentially relevant people based on information they choose to provide.
A match or connection suggestion is not a guarantee that two people will collaborate, respond to each other, become friends, work together or have any particular relationship.
Please use introductions respectfully. Do not use information discovered through Windervale to harass, spam, stalk, impersonate or otherwise inconvenience another person.
You remain responsible for your interactions with other users.
Creative work you submit
Windervale may allow you to submit films, books, writing, music, photography, visual art, zines, magazines, projects, portfolios and other creative material.
You should only submit material that you have the right to submit.
By submitting material, you give Windervale the permission reasonably necessary to receive, review, organise, store and display that material as part of the specific Windervale feature or programme for which you submitted it.
This permission does not mean that Windervale becomes the owner of your creative work.
If a particular programme requires additional rights, licensing, publication permission or another agreement, those terms will be communicated separately.
Copyright & ownership
Unless expressly stated otherwise in a separate written agreement, you retain ownership of the original creative work you submit to Windervale.
Windervale does not claim ownership of your artwork, writing, film, music, photography, designs, ideas or other intellectual property merely because you submit it to the platform.
You are responsible for making sure that your submission does not unlawfully use another person's copyright, trademark, likeness or other protected material.
If you believe material on Windervale infringes your rights, please contact us with enough information for us to understand the concern.
Grants & funding
Windervale may develop grants, creative support, funding programmes or other forms of financial support for independent projects.
Submitting an application does not guarantee selection, funding, publication, exhibition, investment or any other outcome.
Individual programmes may have their own eligibility requirements, application rules, agreements, timelines and payment conditions. Where additional terms apply, those terms will govern the relevant programme.
Nothing on the Windervale website should be interpreted as a promise that funding will be available at any particular time.
Events, exhibitions & festival programmes
Windervale may organise or participate in workshops, exhibitions, festivals, talks, screenings, markets and other events.
Applying to participate in an event does not guarantee acceptance or participation.
Event-specific information may include separate requirements relating to fees, space, installation, equipment, conduct, sales, cancellation or attendance.
Windervale may change an event's programme, venue, schedule or format where reasonably necessary.
How we expect people to behave
Windervale is built around people. Please act like it.
- Do not impersonate another person.
- Do not submit stolen or knowingly infringing work.
- Do not harass, threaten or target other users.
- Do not spam people through introductions or platform features.
- Do not attempt to access another person's account.
- Do not interfere with the platform or attempt to bypass its security.
- Do not use Windervale to facilitate unlawful activity.
- Do not deliberately provide false information in applications or verification processes.
We reserve the right to remove content or restrict accounts where necessary to protect the community, platform or people using it.
The platform itself
Windervale is a developing platform. Some features may change, disappear, be paused or be replaced as the project develops.
We aim to keep the platform available and functional, but we cannot promise that every feature will always be available, uninterrupted or completely error-free.
We may perform maintenance, make technical changes or temporarily restrict access when reasonably necessary.
Suspension & removal
Windervale may suspend, restrict or remove an account, profile, submission or other content if we reasonably believe that it violates these Terms, harms another person, creates a security risk, or is inconsistent with the purpose of the platform.
Where appropriate, we may also remove material without permanently restricting the associated account.
You may stop using Windervale at any time.
Liability
Windervale is provided on an evolving, reasonable-efforts basis. To the extent permitted by applicable law, Windervale and its operators are not responsible for losses arising solely from temporary platform unavailability, third-party services, user-to-user interactions, or decisions made independently by users based on information found through the platform.
Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.
Changes to these terms
Windervale may update these Terms as the platform, programmes and legal requirements change.
When we make a meaningful update, we may update the date shown at the top of this page and, where appropriate, provide additional notice.
Continuing to use Windervale after updated Terms become effective means you accept the updated Terms.
Governing law
These Terms are intended to be governed by the laws of India, subject to any mandatory rights or protections that apply to you under applicable law.
Any dispute arising from the use of Windervale will be subject to the jurisdiction of the appropriate courts in India, unless applicable law requires otherwise.
These Terms are written for Windervale's current platform and programmes and are intended as general website terms. They are not a substitute for advice from a qualified lawyer. Programme-specific agreements may contain additional terms.
